Accommodation Agreement

Article 1: Scope of Application

1. The accommodation contract and related agreements concluded between this lodging facility and the guest shall be governed by the provisions of this agreement. Matters not stipulated in this agreement shall be governed by applicable laws and established customs.

2. Notwithstanding the provisions of the preceding paragraph, in cases where this lodging facility agrees to a special contract that does not violate laws or customs, that special contract shall take precedence.

Article 2: Application for Accommodation Contract

1. Persons intending to apply for an accommodation contract shall provide the following information:

• (1) Name of the guest

• (2) Date(s) of stay and estimated time of arrival

• (3) Accommodation charges

• (4) Other information deemed necessary by the facility

2. If the guest wishes to extend their stay beyond the date indicated in item (2) above during their stay, this shall be regarded as a new application for an accommodation contract at the time the request is made.

Article 3: Conclusion of Accommodation Contract

1. The accommodation contract shall be considered concluded when this facility accepts the application in the preceding article, unless it proves that it did not accept the application.

2. Upon the conclusion of the accommodation contract, the guest must pay an advance deposit equivalent to the basic accommodation fee for up to three days (if the stay exceeds three days) by the date specified by this facility.

3. In the event of cancellation as defined in Article 6 or Article 18, the deposit will first be applied to any cancellation fees, followed by compensation, and any remaining balance will be refunded upon settlement under Article 12.

4. If the deposit is not paid by the specified date, the accommodation contract shall become invalid.

Article 4-1: Waiver of Deposit Requirement

1. Notwithstanding the preceding article, this facility may agree to waive the advance deposit after the conclusion of the accommodation contract.

2. If the facility does not request the deposit or specify a payment date, it shall be considered that such a special agreement has been made.

Article 4-2: Cooperation with Infectious Disease Prevention Measures

1. In accordance with the Inns and Hotels Act Article 4-2, the facility may request cooperation from guests in preventing the spread of specific infectious diseases.

2. Unless there is a justifiable reason, the guest may not refuse this request. If a guest is later found to be a patient of a specific infectious disease after failing to cooperate, the guest shall bear all costs associated with disinfection and facility closures.

Article 5: Refusal to Conclude an Accommodation Contract

The facility may refuse to enter into an accommodation contract under the following circumstances:

(1) When the application does not comply with this agreement

(2) When no rooms are available

(3) When the guest is deemed likely to act contrary to laws, public order, or morals

(4) When the guest is a patient of a specific infectious disease

(5) When the guest makes violent or unreasonable demands on the facility or staff

(6) When accommodation is impossible due to natural disasters or other unavoidable reasons

(7) When the guest’s behavior is overly offensive or abusive and burdens staff beyond reasonable expectations (excluding legitimate requests related to disability access)

(8) When the guest demands unrealistic accommodations that hinder service to other guests

(9) When the guest is intoxicated or causes significant disturbance

(10) When the guest is affiliated with organized crime groups or antisocial forces

Article 6: Guest’s Right to Cancel Contract

1. The guest may cancel the accommodation contract by notifying the facility.

2. If the guest cancels due to reasons attributable to themselves (except in certain specified cases), a cancellation fee will be charged as outlined in the attached table.

3. If the guest fails to arrive by 8:00 PM on the check-in date without prior notice (or 2 hours after the specified arrival time), the facility may consider the contract canceled.

Article 7: Facility’s Right to Cancel Contract

1. The facility may cancel the accommodation contract under the following conditions:

• Similar to Article 5, including legal violations, infectious diseases, violent behavior, natural disasters, drunkenness, organized crime affiliations, and violation of fire safety regulations

2. In such cases, charges for services not yet provided will not be collected.

Article 8: Guest Registration

Guests must register the following upon check-in:

• Name, age, gender, address, occupation

• For foreigners: nationality, passport number, place and date of entry

• Departure date and time

• Other necessary information

Foreign guests without a domestic address must present and allow a copy of their passport.

Article 9: Room Usage Time

Rooms are available from 4:00 PM on the day of arrival until 11:00 AM (10:00 AM during events) on the day of departure. Guests staying multiple nights may use rooms all day except on check-in and check-out days.

Article 10: Compliance with Facility Rules

Guests must comply with the facility’s usage regulations as displayed on the premises.

Article 11: Operating Hours

• No curfew

Staff available from 3:00 PM to one hour after check-in and from one hour before cheka-out

• For stays of 2+ nights, linen change and cleaning will occur every third night with guest consent

• The host will not enter guest areas unless requested or during designated cleaning times

• Events at the entrance will be notified in advance

Article 12: Payment of Charges

1. Accommodation charges are based on the booking site information

2. Charges are payable in advance by designated currency or accepted alternatives

3. Charges apply even if the guest chooses not to stay after check-in availability

Article 13: Facility’s Liability

1. The facility is liable for damage caused by failure to fulfill contracts unless not attributable to it

2. The facility is insured under JAPA Minpaku Insurance

Article 14: Room Unavailability

1. If the contracted room is unavailable, the facility will arrange alternative accommodation with guest consent

2. If no alternative is found, compensation equivalent to cancellation fees will be paid unless the cause is beyond the facility’s control

Article 15: Deposited Items

Guests are responsible for their own valuables and cash

Article 16: Guest Luggage/Items

1. Items arriving before check-in will be stored only if prior notice was given

2. Lost items after checkout will be returned if the owner is identifiable; otherwise handled per the Lost Property Act

3. Facility liability for stored items follows previous articles

Article 17: Guest Liability

Guests must compensate for any damages caused to the facility through intent or negligence

Article 18: Governing Language

This agreement is written in Japanese and English; the Japanese version shall prevail in case of discrepancies

Article 19: Jurisdiction and Governing Law

All disputes shall be settled under Japanese law at a court with jurisdiction over the facility’s location

Accommodation Charges and Cancellation Policy

Charges

• Basic Room Charge (no meals): Varies by date, see booking page

• Optional Fees: Based on guest request

• Taxes: None

Cancellation Fees

• No-show: 100%

• Same day: 100%

• 1 day prior: 70%

• 3 days prior: 50%

• 7 days prior: 30%

• 5 days prior: None

Notes

• If the length of stay is shortened, a fee for the first night will be charged

• Cancellation policies may vary during peak seasons

• Discounts for multiple-night stays or weekday single occupancy may apply

Facility Regulations – KIMINOYA Gujo Hachiman

Article 1: Room Use

• Check evacuation routes upon arrival

• Only registered guests may stay

• Extended stays do not create legal residency rights

• Minors must have parental consent; persons under the influence of substances are not permitted

Article 2: Keys

• The main entrance is auto-locked. Please confirm that the door is locked when leaving.

Article 3: Visitors

• Rooms are for guests only

• Meetings with visitors must take place in the 1st-floor common room by 10:00 PM

Article 4: In-room Behavior

• Do not use open flames or candles without permission

Use of Bedding

Each guest is entitled to one set of bedding. If you wish to use additional bedding, please inform the host in advance. Extra sets are available for ¥1,500 per set.

Please note that using unassigned beds or futons stored in the closet without prior permission may result in an additional charge of ¥5,000, unless there are extenuating circumstances.

Article 6: Additional Guidelines

1. If you notice any issues or malfunctions during your stay, please inform the staff immediately.

2. In cases of intentional or accidental damage or stains to the facility or equipment, the guest may be charged for actual cleaning or repair costs.

3. Commercial photography or events without permission from the facility are not allowed.

4. When entering or exiting the premises during late night or early morning hours, please do so quietly to avoid disturbing neighbors or other guests.
